GENERAL TERMS AND CONDITIONS
1.1. These general terms and conditions ("General terms") apply when you as a consumer ("You" or "Customer"), place an order via www.maratusso.com. The agreement has been entered into between you and Maratusso AS, organization number 919599073. Detailed contact information and other information about Maratusso AS can be found on the Website. The General Terms and Conditions apply only to Customers who are consumers.
1.2. You must be at least 18 years old to order through the website. According to norwegian law, Maratusso does not accept credit purchases for persons under 18 years of age. Maratusso reserves the right to reject or change your orders (for example, if you have provided incorrect personal information and / or have a history of non-payment of debt).
1.3. Maratusso shall not be liable if products are sold out, nor for image or typographical errors on the website, such as errors in the product description or the technical specification, inaccurate prices and price adjustments (such as changes in prices from suppliers, currency changes) or incorrect information on whether a product is in stock or not. Maratusso reserves the right to correct such errors and change or update the information at any time. 2. CONTRACTS AND ORDERS
2.2. A purchase agreement is entered into when Maratusso AS has confirmed your order, and you have received an order confirmation from Maratusso AS via e-mail. Maratusso AS encourages you to keep the order confirmation for any future contacts with Maratusso AS's customer service about the order. You have the right to cancel your order until it has been confirmed by Maratusso AS. If the order is canceled, Maratusso AS will refund any payments you or your credit card company have made regarding the order.
3. CUSTOMER INFORMATION ETC.
3.2. You promise to make sure that no one but you uses your login information. You are not allowed to divulge your username or password to anyone and must ensure that any documentation with username and password information is stored so that unauthorized persons do not have access to the information. You must notify Maratusso AS without delay if there is a suspicion that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login information if you have not given such notice.
3.3. If Maratusso AS suspects that you are abusing your user account or login information or otherwise violating the General Terms, Maratusso AS has the right to block access to your user account. Maratusso AS also has the right to assign you new login information.
4. PRICES, FEES AND PAYMENT
4.1. The prices stated on the Website apply to orders placed on the Website. All prices are stated in NOK/EUR and include VAT. Prices do not include tax and shipping fees given separately.
4.2. We accept payments: VISA, MasterCard, Paypal, Klarna. In the event of a return, the refund will be made to the card you used for payment.
4.3. We do not enter into an invoice / partial payment agreement. You can use Klarna as a payment method.
4.4. Customs duty abroad. When sending abroad, we are not responsible for the customs duties of that country.
5. SPECIAL OFFER
Maratusso AS shall from time to time be able to make special offers on the Website that are more favorable than those contained in these General Terms and Conditions, for example with regard to payment or extended right of withdrawal. Such terms shall apply as long as the special offer lasts and for the specific products that Maratusso AS has specified in connection with this. Maratusso AS reserves the right to withdraw such special offers at any time. Upon termination or withdrawal of a special offer, these General Terms and Conditions shall apply without any changes. Offers on specific products on the Website are only valid for the limited period and until the products are sold out.
6. DELIVERY AND SHIPPING
6.1. Products in stock are normally delivered within the number of working days specified on the Website. Unless otherwise agreed (for example in connection with the reservation of products that are not in stock), delivery will take place no later than 30 working days after Maratusso AS has confirmed the order in writing in the order confirmation. 6.2. The expected delivery time is stated in the order confirmation, in the check-out and / or on the relevant product page on the Website. If there is a delivery delay, Maratusso AS will inform you of this and will continue to keep control of the order. Unless otherwise expressly agreed, and if a delivery is delayed more than 30 working days and not due to you as a Customer, you have the right to cancel the Purchase.
6.3. If a package is to be picked up at a specific delivery location, you must do so within the time period specified in the message. Packages must normally be picked up in person with a valid identification and order number. You will receive a delivery message stating when and where the package must be picked up or received. The message must be given by e-mail, regular mail, and if you have communicated a mobile number, also by phone or SMS. Maratusso AS has the right to charge you a fee of 199 NOK / 20 EUR if the package is not picked up.

You can also follow the package at the tracking link sent in the delivery confirmation. If the package fits in your mailbox, it will initially be delivered there, otherwise it will be delivered to your door. Larger packages end up at the delivery point. You will then receive an SMS when the package can be picked up.

8. RIGHT OF WITHDRAWAL
8.1. Right of withdrawal
8.2. When products are purchased on the Website, you have a 14-day right of withdrawal in accordance with current right of withdrawal law and consumer protection legislation. This means that you have the right to cancel any purchase by notifying Maratusso within 14 days of you or your representative receiving the ordered product.
The right of withdrawal does not apply to the following product types:
8.2.1. Perfume bottles, cosmetics, paint, swimwear or underwear, if the seal / seal is broken. However, most of our swimwear and underwear are not sealed.
8.2.2. The right of withdrawal also does not apply to specially adapted products, goods that are produced according to the customer's unique wishes.
8.3. If you wish to exercise your right of withdrawal, you must, within 14 weekdays of receiving the order, completed the withdrawal form for Maratusso.com can be found here. Or contact customer service by email email@example.com.
8.4. Return the unused item with all the labels intact in the original packaging. If the packaging is unusable, it is possible to pack with another similar packaging. Be sure to pack well so that the product is protected during transport.
Save the return receipt until you have been notified that your return has been processed, as this is proof of the returned return. By returning the item within the deadline, you do not have to inform us that you will exercise your right of withdrawal in another way, if you do not wish to do so
8.5. If you exercise your right of withdrawal, you will pay for the return shipping costs and are responsible for the condition of the product after you have received the product and during the return shipment. The product must be returned within 14 days from the date Maratusso was notified that you are exercising the right of withdrawal. The product must be sent well packaged, in good condition and in a packaging that can withstand the mail. If the item is not returned in good condition, Maratusso has the right to claim a cost for handling unsaleable product. Any returns must be sent to Maratusso in accordance with the methods and instructions given on the Website, form you can find here.
8.6. If you exercise the right of withdrawal, Maratusso will refund the amount you paid for the product including shipping costs. Any additional shipping costs due to the fact that you choose a different delivery than the standard delivery Maratusso offers are exempt from the refund. When returning part of an order, the shipping costs will not be refunded. Maratusso has the right to deduct an amount from the amount to be refunded corresponding to the impairment of the product compared to the original value of the product, if and to the extent such impairment is due to you having handled the product beyond what is needed to determine its function or characteristics.
8.7. You always have the right to order items, try them on at home and return items that do not fit. But unfortunately we have discovered that there is a disturbing behavior among certain customers where you systematically order goods and then return almost everything, which both affects the environment negatively and is expensive to deal with. It may be that we suspect that goods are returned after use or another form of fraud. If we discover such behavior, we reserve the right to block a customer. The block is not limited in time. As usual, we enter into an agreement only when we have sent an email with order confirmation and receipt. Blocking does not take place accidentally and not in individual cases. It is based on several different factors in the customer's behavior, such as: number of purchases, number of returns, order and return relationship, how many use / abuse free shipping and returns, delayed returns or alleged missing goods / returns / deliveries.
8. RIGHT OF RETURN, CHANGES
8.1. You have a 30-day right of return when you shop with us. 8.6. Refunds will be made as soon as we have received the return and processed it, normally this takes about 2-3 weeks from the date you sent the return. 8.9. Maratusso AS have the right not to return the money if the product is damaged or unsuitable for carrying.
9. WARRANTY AND COMPLAINTS
9.1. Some of Maratusso's items may have a guarantee. Information about any warranty period and special warranty terms for each item can be found on the website or in these terms. Warranty on goods only covers defects or deficiencies that are due to production defects, and thus not defects that occur during or after a change in the product's function and appearance, such as rebuilding, upgrading or other configuration of the product. Your order confirmation is valid as proof of warranty.
9.2. The right to file a complaint applies to products that are defective in accordance with current consumer protection legislation. A Customer who wishes to make use of his right to file a complaint regarding an ordered product shall, using the contact information found on the Website, contact Maratusso AS as soon as possible after the defect was discovered. Complaints submitted within two months of you discovering the defect shall always be deemed to have been given in due time. You have the right to file a complaint about products purchased on the Website, within 2 years of receiving the product.
9.3. Maratusso AS shall bear the costs of return shipping for any approved complaints.
9.4. As soon as a product for which a complaint has been lodged has been returned and the complaint is accepted, Maratusso AS will refund you in accordance with current consumer protection legislation. Maratusso AS strives to do this within 30 days after Maratusso AS has received the complaint, but this may be delayed depending on the product type. Maratusso AS reserves the right to reject any complaint if the product in accordance with current consumer protection legislation proves not to be defective. 11. FORCE MAJOR
Maratusso is not responsible for any delays caused by matters beyond Maratusso's control, such as general labor disputes, acts of war, fire, lightning, terrorist attacks, amended regulations by the authorities, technical problems, defects in power / telecommunications / computer communications or other communications and defects or delays in service from subcontractors due to conditions as mentioned above. 12. CHANGES TO THE GENERAL TERMS AND CONDITIONS
Maratusso reserves the right to change these Terms and Conditions at any time. Any changes to these General Terms and Conditions shall be posted on the Website. Changes will take effect as soon as you have accepted the General Terms and Conditions (in connection with a new purchase, or while he / she is viewing the Website), possibly 30 days after Maratusso has informed you of the changes. 14. CURRENT LEGISLATION AND DISPUTE RESOLUTIONS
14.1. Any dispute that may arise shall be resolved amicably in discussions with Maratusso's customer service. If an amicable settlement cannot be reached, Maratusso must comply with the decisions of the Consumer Disputes Committee or similar authorities in other European countries.
14.2. Any dispute regarding the interpretation or application of these General Terms and Conditions shall be governed by and construed in accordance with Norwegian law and shall be settled exclusively by the courts of Norway.
